Terms and Conditions of Purchase
1. Summary
1.1. The purchase and sale rules of this electronic store (hereinafter - the Rules) are a legally binding document for the Buyer and the Seller (hereinafter - the Seller), which sets out the rights and obligations of the Parties. 1.2. The Seller reserves the right to change, amend or supplement these Rules at any time. The Buyer is informed about changes in the Rules on the website of the electronic store.
2. Object of the Agreement
2.1. The Seller undertakes to hand over to the Buyer by the right of ownership the quality Product(s) ordered by the latter, and the Buyer undertakes to accept the ordered Product(s) and pay for them the price agreed on by the Parties and in accordance with the conditions, terms and procedure laid down in these Terms.
3. Seller's Rights
3.1. In case of important circumstances, the Seller may temporarily or permanently suspend the operation of the online store without prior notice to the Buyer. 3.2. If the Buyer violates their obligations or attempts to disrupt the operation, stability, or security of the online store, the Seller has the right to limit or suspend the Buyer's access to the online store without notice.
4. Seller's Obligations
4.1. The Seller commits to provide access to the online store’s services, the operating conditions of which are defined by these Rules. 4.2. The Seller is obligated to deliver the goods purchased by the Buyer according to the chosen delivery method and based on the conditions set by these Rules. 4.3. If unforeseen circumstances prevent the Seller from delivering the ordered goods, the Seller has the right to terminate the sales contract after informing the Buyer. The Seller may offer a similar product, and if the Buyer refuses, the Seller must refund the amount paid within 5 (five) business days. 4.4. If the Buyer exercises the right outlined in section 5.2 of the Rules, the Seller must return the money paid within 5 (five) business days from the date the returned product is received. 4.5. The Seller may withhold a refund until the products are returned to the Seller or until the Buyer provides proof that the products have been sent, whichever comes first.
5. Buyer's Rights
5.1. The Buyer has the right to purchase goods from the online store according to these Rules. 5.2. The Buyer has the right to withdraw from the sales contract within 14 (fourteen) calendar days from the date of delivery, except for products made to specific instructions. 5.3. The Buyer can exercise the right under section 5.2 only if the product is undamaged, its appearance has not fundamentally changed, and it has not been used.
6. Buyer's Obligations
6.1. The Buyer must pay for the purchased goods and accept them according to the procedures specified in these Rules. 6.2. If the Buyer refuses to accept the goods without a valid reason, they must cover the return costs if requested by the Seller. 6.3. Upon delivery, the Buyer must check the condition of the shipment and the product(s) together with the Seller or the person delivering the shipment. 6.4. By using the online store, the Buyer confirms that they agree to and must comply with these Rules.
7. Prices of Goods
7.1. Prices in the online store are indicated in euros, including VAT. Delivery costs, if applicable, are added to the total price after the order is confirmed.
8. Order and Payment
8.1. After visiting the online store, the Buyer selects products and adds them to the shopping cart. After completing the shopping cart, the Buyer enters the necessary personal data for order fulfillment, such as their name, surname, address, and phone number. The Buyer confirms that they have read the Rules and submits the order. 8.3. Payment can be made via Swedbank, Seb, Luminor, Citadele, Šiaulių bankas online banking services, as well as Visa / MasterCard credit cards. Payments are processed in euros via the Paysera payment platform.
9. Delivery of Goods
9.1. The Buyer must provide a delivery address and mobile phone number when placing the order. 9.2. The products are delivered by a representative authorized by the Seller. The Buyer must select a delivery method in the order form and can choose from the following: 9.2.1. Delivery to the Buyer’s address via courier service; 9.2.2. Pickup from an "Omniva" or "LP EXPRESS 24" self-service terminal. 9.3. If the Buyer selects delivery via courier, the courier will agree on the delivery time with the Buyer via the provided phone number. If the Buyer chooses a self-service terminal, they will receive an SMS with a pickup code. The product must be collected within 7 days of receiving the notification. 9.2. The Buyer must personally accept the products. If the Buyer cannot accept them and the products are delivered to the specified address, the Buyer cannot raise claims about delivery to the wrong person. 9.3. The Seller delivers the goods based on the delivery times specified in the product descriptions. 9.4. All product features are described in the product description. The Seller is not responsible if the product's color, shape, or other parameters do not match the real product due to the Buyer’s monitor settings. 9.5. If the Buyer withdraws from the purchase contract, the Buyer will be refunded all payments made, including any delivery costs paid by the Buyer.
10. Product Returns
10.1. Quality goods can be returned within 14 days of receipt. Defective products are repaired, replaced, or returned in accordance with the provisions of the Civil Code of the Republic of Lithuania. 10.2. The following conditions must be met when returning products: 10.2.1. The product must be returned in its original, undamaged packaging (this condition does not apply to defective products); 10.2.2. The product must not be damaged; 10.2.3. The product must not be used and must retain its original appearance, with no damaged labels or removed protective films, etc. (this condition does not apply to defective products); 10.2.4. The returned product must be in the same condition as when received by the Buyer (this condition does not apply to defective products); 10.2.5. The Seller has the right to refuse to accept returned products if the return conditions are not met; 10.2.6. Products must be returned using the method specified by the Seller within 14 (fourteen) days from the date of receipt (this condition does not apply to defective products – these are returned within the statutory warranty period). 10.3. Returns of good quality products are carried out in accordance with Article 6.22810, part 1 of the Civil Code. 10.4. For accepted products later rejected by the Buyer, payments will be refunded within 14 (fourteen) days from the product return date, provided there is no reason to reduce the refund. Other costs (such as banking fees, interest, or transportation) are not refunded. The refund is made to the bank account from which the order was paid. 10.5. The Buyer cannot return a product that was made or customized for them, nor items unsuitable for return due to health or hygiene reasons if unsealed. Additionally, opened audio, video recordings, software, and similar items, as well as newspapers, magazines, and books, cannot be returned.
11. Information on the Online Store
11.1. The Seller does their best to ensure the information on the website is accurate and up-to-date. The Seller reserves the right to change, correct, or partially or fully remove information from the website at any time. 11.2. The Seller reserves the right to adjust prices as necessary without prior notice. Price changes do not apply retroactively to already paid but undelivered orders. 11.3. If there are doubts about the accuracy of the website information, it is recommended to contact the Seller before placing an order.
12. Privacy Policy and Personal Data Protection
12.1. The Seller processes personal data in compliance with personal data protection laws and other legal regulations for direct marketing, surveys, competitions, and games purposes. More details can be found in the Privacy Policy. 12.2. By purchasing from the online store, the Buyer confirms that they have thoroughly read the Privacy Policy and agree to the processing of their personal data provided for the purposes of executing the sales contract according to these Rules.
13. Final Provisions
13.1. These Rules are drawn up in accordance with the laws of the Republic of Lithuania. 13.2. These Rules and the relationships between the Parties shall be governed and interpreted in accordance with the laws of the Republic of Lithuania. 13.3. All disputes arising from these Rules will be resolved through negotiation. If no agreement is reached, disputes will be settled in accordance with the laws of the Republic of Lithuania. 13.4. The Parties are exempt from fulfilling their obligations under these Rules in the event of force majeure.
